About this policy
Freedom & Father Pty Ltd (ABN 20 628 193 331), trading as Seeking More (“we”, “us”, “our”), runs a chiropractic and wellness practice at 37 Quiver St, Bokarina, Sunshine Coast, Queensland.
This policy explains, in plain language, how we collect, hold, use and protect your personal and health information. It applies to everyone whose information we hold, including clients, prospective clients, carers and visitors to our website. Our contact details are at the end.
What this policy covers
This policy covers all personal information we hold, whether on paper, in our electronic systems or through our website at seekingmore.com.au.
It sits alongside the shorter collection notice on our intake form, which tells you the essentials at the moment you provide your information. This policy is the fuller statement of how we handle it.
Our obligations
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). As a health service provider we are covered by the Privacy Act regardless of our turnover.
The health information we hold is treated as “sensitive information”, which carries a higher level of protection than ordinary personal information. We also handle your information in line with the professional standards of the Chiropractic Board of Australia and AHPRA.
The information we collect
We collect only what is reasonably necessary to care for you. Depending on your involvement with us, this may include:
Identity and contact details: name, date of birth, sex, address, phone, email, occupation and emergency contact.
Medicare and funding details: your Medicare number and, where relevant, details needed to administer a Home Care Package or other funding.
Health information: your health history, symptoms, prior care, physical, chemical and emotional stress history, lifestyle information, childhood experience responses, our assessment findings, postural photos, diagnostic scans, your care records and your own reported experience of care.
Financial details: payments, invoices and claim records.
Photographs and video: where you give specific consent, images or video of you used for education and social media awareness, separate from any clinical images and never a condition of your care.
Website information: limited technical data when you visit our site, described below.
Health information, and any information about your health, is sensitive information under the Privacy Act.
How we collect it
We collect most information directly from you: through our intake form, in conversation, by phone and by email.
Sometimes, with your consent or where the law allows, we collect information from others involved in your care, such as your GP or another treating practitioner, a family member or carer, or a Home Care Package provider or coordinator. If we ever collect your information from someone other than you, we take reasonable steps to make sure you are aware of it.
Why we collect it
We collect, hold and use your information to:
provide and manage your care
communicate with you about appointments and your care
process payments and, where relevant, funding claims
meet our legal, professional and record-keeping obligations
improve our services and, where you have agreed, keep you informed about the practice
If you choose not to provide the information we ask for, we may not be able to care for you safely, or at all.
Consent
Because health information is sensitive, we collect it with your consent, which you give when you complete our intake form and take part in care.
You can withdraw your consent, or ask us to stop a particular use of your information, at any time, though this may affect our ability to care for you. Where the law requires or authorises us to collect, use or disclose information without consent, we may do so.
How we use and disclose your information
We use your information for the purposes set out above. We disclose it only when necessary, and to:
other health or wellness practitioners involved in your care, with your consent, such as when we refer you
service providers who help us run the practice under confidentiality obligations, including our practice management and booking software, secure cloud storage and, if used, a clinical note-taking (AI scribe) tool
Medicare, DVA, a private health insurer or a Home Care Package provider, where needed to process a claim or coordinate funded care
others where you have consented, or where we are required or authorised by law, for example a court order or a serious threat to someone’s life, health or safety
We do not sell your information, and we do not use it for purposes unrelated to your care without telling you.
Direct marketing
If you have agreed, we may occasionally contact you with practice news, health information or offerings. Every such message gives you an easy way to opt out, and you can tell us to stop at any time. We do not provide your information to other organisations for their own marketing.
Photography and filming
Some clients choose to be photographed or filmed so we can share their experience for education and to raise awareness of our care, usually on social media and our website.
We collect and use this material only where you give specific, written consent for it, separately from your consent to care. Being photographed or filmed is entirely your choice and is never a condition of receiving care.
You can withdraw your consent at any time. We will then stop using the material and remove it from the channels we control, though we may not be able to recover copies that others have already shared or downloaded.
Disclosure outside Australia
Some of the software and service providers we use to run the practice may store or process information on servers outside Australia, or may be operated by companies based overseas. Where this happens, we take reasonable steps to ensure your information is handled consistently with the APPs.
The main country your information may reach is the United States. Our website is hosted by Squarespace, which stores data in the United States. Our online intake forms are provided by Finger-Ink, a New Zealand company that hosts form data in the United States. Our practice management system, Zanda, stores Australian account data on servers in Australia.
Where your information is held or processed overseas, we take reasonable steps to ensure it is handled consistently with the APPs. If you have any questions about these providers, please ask.
How we store and protect your information
We hold information in both electronic and paper form. Electronic records are kept in secure, access-controlled systems, with measures such as passwords, encryption where available and staff access limited to those who need it. Paper records are stored securely with the same limits on access.
We take reasonable steps to protect your information from misuse, loss and unauthorised access, modification or disclosure. When information is no longer needed and we are permitted to destroy it, we do so securely.
How long we keep your information
We keep your health records for as long as required by law and professional standards. For adults, this generally means at least seven years from your last visit. For anyone who was under 18 when last seen, we keep records until they turn 25.
We may keep some information longer where the law requires, or where it is needed for an insurance or legal matter such as a complaint or claim, in which case records may be kept until that matter is resolved. When we no longer need it, we destroy or de-identify it securely.
Accessing and correcting your information
You can ask to see the information we hold about you, and ask us to correct anything that is inaccurate, out of date or incomplete.
We will respond within a reasonable time, usually within 30 days. In limited circumstances we may need to decline access, in which case we will explain why in writing and how you can respond. There is no charge to make a request, though a reasonable cost may apply to retrieve and copy extensive records.
Complaints
If you are concerned about how we have handled your information, please raise it with us first, so we can try to put it right. We will acknowledge your complaint promptly and aim to resolve it within 30 days.
If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.
Data breaches
We take steps to prevent data breaches. If a breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme under the Privacy Act, which includes notifying you and the OAIC where required.
Our website
When you visit seekingmore.com.au, we may collect limited technical information, such as your device and browser type and the pages you view, to keep the site working and improve it. Our site may use cookies and analytics tools. You can set your browser to refuse cookies, though some features may not work as well. If you send us information through the site, we handle it under this policy.
Changes to this policy
We update this policy when our information handling practices change. The current version is always available on our website, and the date at the top shows when it was last updated.
